Terms of Service

By accessing the Site, submitting a form, or opting in to receive text messages from Almario Estates, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site or our SMS Program.

You must be at least 18 years old to use the Site, submit any form, or opt in to our SMS Program. By using the Site or providing your mobile phone number, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement.

If you are under 18, please do not submit personal information or sign up for our SMS Program. We will delete any information we discover was provided by someone under 18.

Almario Estates provides residential real-estate services in San Diego County, including buyer representation, seller representation, market analysis, home valuations, and related consulting. Licensed real-estate services are provided through Coldwell Banker West (DRE #02137777). The Site provides general information, listing search, neighborhood content, and a way to contact our team.

Information on the Site is provided for informational purposes only and does not constitute legal, tax, financial, or investment advice. You should consult appropriate licensed professionals for advice specific to your situation.

Our SMS Program is a closed-loop, transactional and conversational messaging program for current and prospective real-estate clients. Use cases include:

• Appointment scheduling & reminders for consultations, showings, inspections, and closings.
• Listing alerts & property updates for homes that match criteria you have shared with our team.
• Transaction status updates such as offer acceptance, contingency milestones, and document signing requests.
• Market reports & neighborhood updates relevant to the areas you have asked about.
• Replies and follow-up questions from our team to questions you have sent us.

You consent to receive these messages only after you have expressly opted in by checking the SMS consent box on our Site, signing a representation or listing agreement that includes SMS consent, or texting an opt-in keyword to a number we publish. Consent to receive marketing messages is not a condition of any purchase or service.

Message frequency varies based on the stage of your real-estate transaction and the questions you send us. Most clients receive fewer than 10 messages per month.

Message and data rates may apply. Any messages you send to or receive from Almario Estates through the SMS Program may incur charges from your mobile carrier under your wireless plan, including charges for SMS, MMS, and cellular data. Almario Estates does not charge you a fee for participating in the SMS Program.

Check your wireless plan for details on your messaging and data charges. You are solely responsible for all charges imposed by your mobile carrier resulting from your use of the SMS Program.

You may opt out of the SMS Program at any time. To unsubscribe:

• Reply STOP, END, QUIT, CANCEL, or UNSUBSCRIBE to any message you receive from us.
• After you send STOP, we will send a single confirmation message acknowledging that you have been unsubscribed. You will not receive any additional messages unless you opt in again.
• You may also opt out by emailing hello@almarioestates.com with the subject line “SMS Opt-Out” and your mobile number, or by calling (619) 261-9129.

If you change or transfer your mobile phone number, please notify us so we can update our records and avoid sending messages to the wrong recipient.

Mobile carriers are not liable for delayed or undelivered messages. Delivery of SMS messages depends on the effective transmission from your mobile service provider and is outside of Almario Estates’s control. We are not responsible for any delays, failures, or losses resulting from a mobile carrier’s network conditions, your device, or the public internet.

Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, Virgin Mobile, Cricket, and other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

Property listings displayed on the Site are sourced from the San Diego Multiple Listing Service via IDX feeds. Information is deemed reliable but not guaranteed. Properties displayed may be listed or sold by various participants in the MLS. Pricing, availability, and listing details may change without notice and should be confirmed with Almario Estates or the listing agent before relying on them.

Almario Estates complies with the federal Fair Housing Act, the California Fair Employment and Housing Act, and Equal Housing Opportunity standards. We do not discriminate based on race, color, religion, national origin, sex, sexual orientation, gender identity, familial status, disability, source of income, or any other protected class.

You agree not to:

• Use the Site or SMS Program for any unlawful, harmful, fraudulent, or harassing purpose.
• Submit false, misleading, or impersonating information through any form or message.
• Attempt to gain unauthorized access to any portion of the Site, our systems, or our service providers’ systems.
• Scrape, copy, or republish MLS listing data or other proprietary content without our written permission.
• Interfere with the Site’s operation or security or upload viruses, worms, or other malicious code.

The Site, its design, branding, text, photography, graphics, and code are owned by Almario Estates or its licensors and are protected by U.S. and international intellectual property laws. Except for MLS listing data, which is governed by the applicable MLS rules, you may not reproduce, distribute, modify, or create derivative works of any Site content without our prior written consent.

THE SITE AND SMS PROGRAM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. Almario Estates DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT MESSAGES WILL BE DELIVERED ON TIME OR AT ALL.

TO THE FULLEST EXTENT PERMITTED BY LAW, ALMARIO ESTATES, ITS OWNERS, EMPLOYEES, AND VENDORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SMS PROGRAM, INCLUDING LOSS OF DATA, LOSS OF BUSINESS, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless Almario Estates, its owners, employees, and vendors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site or SMS Program, or your violation of any law or third-party right.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the Site or SMS Program will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Site or SMS Program after changes take effect constitutes your acceptance of the updated Terms.

Our collection and use of personal information in connection with the Site and the SMS Program is described in our Privacy Policy, which is incorporated into these Terms by reference.
